I had 14 windows installed by Performance Windows back in May of 2024 and they pulled a building permit and completed the job back in May 2024. There are missing screws in the windows and they have never been inspected in order to close the building permit. I can not sell my house until this permit is closed. I have called the company numerous times and have had no results. I am considering suing them for breach of contract.

Thank you for bringing this matter to our attention.  Mr. ********* is correct that his permit should have been closed by now.  We have talked to the County and have now called Mr. ********* twice in order to schedule a final inspection so we can close the permit.  Once we get this done, we can close it out.  We appreciate Mr. *********'s patience.

Purchased windows March 18, 2022. I still have my contract with the company, photo evidence start to finish, and video recordings of phone call interactions with the company. They left my house in a worse condition then it was to begin with. They caused thousands in damages and never fixed the damage. I did leave a complaint earlier and the company replied to it but when I clicked the link to reply it told me there was no account attached to my email. That makes no sense since I have to have one to write one and it was sent to my email that I was responding to. Now I cannot respond back. I now recreated my account and have to submit another complaint. I am not happy that I cannot respond to my original complaint. They need to be held responsible. They should not be allowed to have an A rating when they are doing business this way. The BBB should NOT be accepting bribes or payouts on the matter or blocking people from responding. This is something I will never let go. I will create millions of accounts until it is resolved. This company needs to rectify all the thousands of damages they caused to my home. I am more than willing to share all of the documents, photos, and videos. This company should be shut down in my opinion. Also shame on you for blocking my account from being able to reply. I still have the confirmation email of my original complaint. They responded to the previous complaint that all damage was done prior to them but I have all of the proof of the contrary. They need to fix what they have done! We’ve been dealing with this long enough.

      Hi *******,

There are reviews and complaints. The first thing you left and that I responded to was a review, that's why you can't respond to my response. This is a complaint.

As I said in my review response, I was under the impression we had addressed all of the drywall and other interior cosmetic issues previously. If we haven't, I'm happy to send somebody out to assess and if there are still things left, to do them. We won't be siding your house as you didn't have siding around those windows when we arrived. Please let me know how you'd like to proceed with the interior.

      Thanks

      Hi *******,

I'm open to the idea of there being some repair but we'd have to set eyes on what is there before doing so. I can't pre-commit to any course of action without seeing it in person in the current moment. The installer who I would be coming with is our main one. Is this something you're open to doing or not?

      Complaint: ********

I am rejecting this response because:

You have already come out here and looked at the home. I don’t see the difference it will make you coming out again now then it was when the damage was first caused. I have also sent you all of the pictures of the damages. Your men didn’t properly fix the damages. We do not want to use the same contractors that caused the damage in the first place. We don’t have any trust in you or your contractors anymore. Your “supposed exports” said there’d be roughly $1000 in repairs. We’ve had multiple companies come out to quote us for the repairs ranging $24,000 and up to repair just the damages your company has caused. It’s going to cost us more in the damages your company has caused than the cost of the windows.

      Sincerely,
      ******* *****

I had a door to door sales man named ******* knock on my door. I kindly said we were not interested and said please to respect my no soliciting sign. He then argued legally he doesnt have to listen to the sign. I said youre right but Im still not interested. He then continued to yell and put his door in my door frame preventing me shutting the door. He yelled at me that I am being financially dumb because he is trying to help. He then called me names using derogatory terms ****** he was very rude and when I threatened to call the cops he finally left. But when leaving he spit on my walk way. I am not trying to do anything but get this company fined for this or this guy terminated.

I did use this opportunity to do a No Soliciting sign refresher training.

One of Performance windows "marketing team" came to my house today. We have a clear NO SOLICITING sign and despite this, he approached my fiance to begin trying to sell her windows. She was on the phone and working, she tried to point this out to him, but he kept talking over her. She tried to politely say no, but he kept insisting he should come inside and measure. He kept highly pressuring my fiance to let him in the house while she was alone! Finally he just said "he would come back later" and left. He did come back later, but fortunately I was home this time. He tried lying to me saying "your fiance scheduled an appointment for me to measure for windows" again trying to gain entry into our house! I know this to be false since the whole thing is on camera. At this point I was livid and told him we had no appointment and pointed out the NO SOLICITING sign right in front of him. His response was "im not soliciting I am part of the marketing team" I asked him where is permit was and he said "he didn't need one" which is a complete lie in Fort Worth. This company is using high pressure and downright aggressive tactics to try and gain entry into peoples houses.

Thank you for bringing this matter to our attention. We take customer interactions very seriously as well as no Soliciting signs.  After speaking with our salesperson involved in this complaint, his interaction was very different than Mr. ******* is alleging.  Please have Mr. ******* provide video evidence of misconduct for verification and potential re-training of sales staff.  We will also re-train local reps about contacting homes with no soliciting signs.

      Thank you!

I am writing to express my frustration regarding a recent door-to-door solicitation by one of their representatives at my home on 12/10/24. Despite having a prominently displayed "No Soliciting" sign, their representative disregarded this clear request and knocked on my door. The purpose of a "No Soliciting" sign is to ensure privacy and prevent unsolicited interruptions. By ignoring this sign, their representative not only disrespected my wishes but also demonstrated a lack of regard for professional and ethical standards.I value my privacy and expect companies to honor these boundaries. I urge the company to better train their employees to recognize and respect "No Soliciting" signs in the future. Additionally, I request that you confirm that they have addressed this issue and ensure it does not happen again.

Thank you for bringing this matter to our attention.  We take No Soliciting signs from our potential customers at each door we knock very seriously.  We have enacted a retrain to our knocking staff and addressed and trained on doors that have a No Soliciting signs.

Again, thank you for alerting us to this issue.

7/31/24 - Austin **** to door salesman for Performance Windows claimed to be a 'marketing rep, not here to sell me anything', then proceeded into a sales pitch.First, I have a very clear "No Soliciting" sign on my front door that was ignored.Second, the "not a salesman" then mentioned a "positive review" as requirement for extra discounts on the work to be done.Ignoring a No Soliciting sign (even doing so by disguising the purpose of the solicitation) and an exchange of discounts for a positive review, if not illegal, are certainly on the edge of legality.

      Business Response

      Date: 08/01/2024

The big issue here is that the Marketing Rep, who sets appointments for Salesman, ignored the "No Soliciting" sign.  We train them to be attentive to homeowners who wish to not have any solicitation.  Since, I dont know the specific Rep, I will have our ************* review procedures with their staff.  As far as discounts for positive reviews.  This Rep is an appt setter.  His/Her job is to generate interest in the product.  To say we give discounts only based on positive reviews was a misstatement that will be corrected.  Rest assured, that person is not a salesperson, merely generating interest in and setting up appointments.

We appreciate you feedback and will continue to train staff.

Purchased windows October 2023. One of the windows doesnt fully close or lock. Two of the windows are uneven. One of the screens were missing. When Performance Windows finally ordered a new window (only one) it sat in a warehouse until finally discovered. They didnt call to schedule. They just stopped by one day unannounced and not scheduled. When it was finally installed, it was the wrong size. We were advised it was not measured correctly for a second time. So that window still wont close all the way or lock. They knew nothing about the uneven windows. They replaced the screen with one the wrong size (has gaps). That was on May 22nd. As of today, July 5th, I have had no response or communication from Performance Windows and have no idea when they will fix our issues.

My front door is clearly labeled with two "No soliciting" signs. Despite these signs, a representative from this company rang my doorbell today, 2024-04-30, around 11:20 AM. I confirmed that the representative is able to read, and confirmed that he had read these signs. I closed my door and he continued to talk to me through the door, so I opened the door and said "do not come back". He then assented and left the property. Those signs are there for a reason; I work from home, and this interaction took me out of an important meeting.

On August 1, 2023, A solicitor working for Performance Windows told us they were looking for "advertising homes" and we agreed to set up an appointment with their marketing director, *************************** the next day (August 2, 2023). He seemed knowledgeable and genuine and the product (Alside Windows) seemed like a quality products. He told us that this project would be in the $60,000 range from a competitor, but since we were an advertising house they would cover labor and give us another discount on top of that in exchange for a good review, the right to use our before and after photos and address on flyers, and the sign in front of our house for 60 days. The "advertising house" price would therefore be: $28,790, but we had to give a hard answer immediately. My wife and I were given about five minutes to discuss, we had no way to get a competing quote, but trusting the salesman was honest, I thought this was a good opportunity to get our windows replaced at a discount. We wound up entering into the contract for the stated amount, half to be paid up front and half at completion, and financed for 132 months with Synchrony Bank.A week passed by and I started receiving more door to door solicitors with almost identical sales pitches to Performance Windows (for other services), which caused me to see the dishonest nature of the sales pitch. Specifically, they claim that your house can be an "Advertising House" for a discount but for limited time and claim to have serviced nearby neighbors, all of which I believe are complete fabrications. On August 18, 2023, I decided to get another quote for the same windows which came in at a little under $18,000. I decided to call performance windows and ask if I could be removed from my contract and they informed me that the windows were already being custom built and it was unlikely.I'd like to report them for the dishonest sales tactic and hope to escape my contract on the ground of fraud or misrepresentation.

      Business Response

      Date: 04/29/2024

******************** signed a contract on August 8, 2023.  He did call and speak to our Market Manager, *************************** about the contract.  We were not able to verify that the window that he was quoted "$18,000" was the same as what we sell, therefore, it is unknown if this is a true comparison.  Regardless, on 8/20/2023, we cancelled the windows contract for ******************** and refunded his down payment that he had financed with Synchrony Financial.
