      On March 18, 2024 we signed a contract to build a custom home with ***** Podwinski at ISW builders and put down a down payment of $15,000. We were verbally told that $5,000 would go towards the house plan process and the additional money would go towards the house. My Father in law Dr. *** ***** *** also signed a contract with ***** on or around the same date and put $15,000 down towards the completion of his own home adjacent to ours. The plan process took into July. We would make changes with ***** and the plans would come back from ***** with multiple changes missing. For instance it took 5 sets of plans before a door was changed. This change was noted by us on the first set of plans. In July, days before our house plans were finalized *****'s project manager ***** ******* stated to my Father-in-law that ***** was in over his head and his other projects were 7 months behind due to subcontractors being unwilling to work with ***** due to late payment. She later informed us that our house plans had taken so long because ***** had not sent the changes we made to his drafter despite ***** telling us each time that it was the drafter who was not making the changes he sent over. We subsequently terminated our contract with ISW builders. ***** stated multiple times and in writing that he was reviewing the situation and did intend to return a portion of our and my FIL's deposit. Per our contract we requested receipts and deliverables, such as the PERC test and bid package ***** claimed to have. ***** stated in writing he would provide us the bid package, and did not do so. He has also returned none of our deposits despite stating in writing in August that he would.

      I am attaching the correct documents here.  Attached please find our contract, and emails from ***** stating his intent to return a portion of our deposit.
