Hello Ive been trying to reach the company handling the **** checks that was mailed out since January I was told it would come in 6 weeks but the first ****** never put in the right info I also called in February and she put in the right information. I spoke to someone today named ******** who was really rude and hung the phone up on me while I was trying my hardest to work with her to find out where my money is. The first check was stolen and cashed in someone elses account and I have no access to. I was told they would help me get my money but they never did its been 2 months since I called in February and nothing was ever sent to me. We have reviewed our call recordings, and while the disconnected call was unintentional and due to a technical issue, unfortunately we have identified instances where the support and the information provided to the complainant did not meet our standards. We are following up with the representatives involved.
We can confirm that the void date for checks issued in the first distribution was August 4, 2024. The complainants first call to Rust about this check was received on January 13, 2025, by which point that check was already void and non-reissuable. However, their check from the second distribution (in the amount of $79.82) is in the process of being reissued and we expect it to mail some time next week. Signed up for an phone app called Changed. Suppose to help with debt and saving money. May 2024 they stopped any investing. This is the message I received -May 1, 2024: Our banking partner Synapse was in the process of being acquired by a company named ***********. During that process, we were informed that the functionality of the *************** would continue without interruption and we should expect to continue utilizing the platform in the way we have in the past. I waited for the refund. This note came out in January 2025-expect to receive this email on Friday 1/24/25**. Heres what you need to know about the upcoming distribution process:Email Details: You will receive an email from ******************************* or ************************************************************************************************* with the subject line: "Evolve Distribution Process and Payment."What to Expect:The email will outline the balance Evolve intends to pay out and the contact information they have on file for you.If any updates to your information are needed, youll be able to provide them directly to Evolve.I never received this email. I did send one on 1/29/25 requesting a statement to explain the amount I would receive. Never came, did receive a check around 2/7/25 with no statement. I called today on 2/17 and my email was received but I can't get an answer on when I will receive this statement. I have requested interest since I didn't have access to these funds for over 8 months. I can't get a straight answer and can't cash the check until I know more about the amount.Business Response

**** is in receipt of complaint #********, which relates to the distribution and payment processes to return funds held by ****** to Synapse Brokerage end users impacted by the ******* bankruptcy. Rust specializes in class action settlements and similar programs, and is serving as the administrator to disburse funds to end users of Synapse Brokerage that the Bank has held since the Synapse bankruptcy.
Rust was engaged to disburse certain payments, including the complainant's payment. Rust had no role in calculating the amounts due to affected customers and cannot provide breakdowns as to how they were calculated. We do not have access to customers statements or similar information.
We are bound by the terms of our engagement in this matter to distribute only the approved amounts, and we therefore cannot honor requests to pay different amounts (such as the complainant's request for interest). The amount the complainant received represents her full, approved balance;there is no process for appeals in this matter.
We have been in contact with the bank regarding this complaint and they have agreed to provide the complainant with the requested statements, but we do not have any information regarding the timing for this.Customer Answer

I am rejecting this response because: They had my money from May 2024 to February 2025. Money, I did not have access to and lost interest when it could have been in an interest-bearing account. Why should I be penalized for the company's inability to handle the phone app, Changed. I was not asked about this and during the whole time, when I requested answers, was referred to a FAQ from the company. No one would talk to me. I know there are exceptions, and I can't believe this agreement does not allow for interest or whatever they want to call it when they made interest for having my money this whole time. In March of this year, i submitted a claim regarding action taken against **** *******, and ****** ****** and his companies ***************************, ********** and ***********. Included in this case was Performance Arbitrage Company. After submitting the required paperwork, I was advised that ************ could provide updates regarding the status of payments. Each month, I have called them at ************. And each time, I get the same scripted response (We have your claim, no new information, could take a few months). On October 7th, 2024, after calling and receiving the same response for 6 months, I decided to call Rust Consulting directly. The operator looked up the case and gave me a number to call for the status. The number was the same ************ that I used for Vets Lending. I am frustrated that there seems to be no one who can give me more specific information. Rust Consulting started mailing out checks in December, 2023, according to website data. I want to be sure that my claim is being processed, as I am due a significant amount of money. I also fear that I may get a check that does not match up to the amounts that I took the time to establish. And if that is the case, I worry that I wont be able to request further payments since July 31st was the last day to make a claim. Rust has received a timely claim form from the complainant.
Regarding the reference to payments beginning in December 2023, these were specific to a group of consumers who were pre-identified to receive payments; payments based on claim forms have not yet begun to be sent, and those claim forms are still being reviewed and validated. Rust is working closely with the **** on this process. If anything further is needed from the complainant to validate her claim, we will contact her, and she will have the opportunity to provide any necessary information.

Rust Consulting ***************************************** company was responsible for sending out settlement checks from a class action lawsuit to drivers that worked for **** and LYFT car service. $328 Million was the settlement that was filed by the ****************, ******* ***** of ********. My the first check to the correct address the one on file with them. I called about Rust Consulting Rust Consulting at ************ about my second check i was told my second check was sent out to address that Rust Consulting decided changed without my permission or any reason. Rust is in receipt of complaint #********, which pertains to settlements that the ********************* of the Attorney General reached with **** and Lyft.Rust specializes in class action settlements and similar programs involving notification, contact centers, claims processing, and fund distribution. Rust is a neutral third party and was engaged to carry out certain administrative aspects of the settlements as established by the parties.
The complainants notice for the Lyft settlement was returned to Rust by **** as undeliverable in July of 2024. The industry standard practice in these situations is to conduct a trace for an updated address. Rust mailed his Lyft settlement check to the address obtained via trace, and the check was cashed.
We have no information as to why his **** notice was successfully delivered by **** but his Lyft notice was not; the undeliverable Lyft notice triggered the trace that lead to the address update. We have reached out to the complainant directly and provided a copy of the cleared Lyft check for the purposes of initiating a fraud investigation.

I received email on 4/23/24 from Pay Pal stating I was receiving a refund of $47.70 as a result of Ring Settlement with FTC and Rust Consulting would be handling the refunds and furthermore go to Pay Pal to secure the funds. I called on or about 4/24/24 & informed representative with Rust Consulting that I do not use Pay Pal and would need a paper check. I was told to check back in 30 days they could not issue check at this time. 30 days (May) went by I called again, and they confirm my address and was told they would have to update the account and that would take another ***** days. In July I called again and was told the claim was still pending. Then on 7/26/24 I got a suspicious email from ************************* @ *********************** stating they got the money (a little emoji money bag) for invoice (********) & a Adobe attachment showing for Norton Antivirus subscription.I don't have a Norton Antivirus subscription. Now I also received in my Promotion emails Pay Pal Correspondence dated 5-15 Open account/ 5-22 a $15 offer/7-15 account statement/8-14 account statement. I never opened these emails because I did not open a Pay Pal Account. On 7/26 I called **** spoke with Supervisor **** who said contact Pay Pal you got your money. I called Pay Pal a supervisor told me the account funds had been put back on ***************************** Rust Consulting. I again sent email to Rust Consulting & on 7/31/24 & 8/7/24 received denial emails. On 8/14/24 Pay al sent another email telling me my account statement is ready. Someone at Rust must have given my email information to Pay Pal to open the account and someone at Pay Pal and Rust Consulting knows what's going on with the Fraudulent disbursement of funds due to everyday people. To think the **** authorize Rust Consulting to handle this matter! I would like to know what is going on and who open this account with ****** and why was my Paper check never mailed? **** is in receipt of complaint #******** which relates to FTC v. Ring, No.1:23-cv-1549 (D.D.C.). Rust specializes in the administration of class action settlements and similar programs involving notification, contact centers,claims processing, and fund distribution. **** is a neutral third party and was engaged to carry out certain administrative aspects of the settlement and to answer class members questions.
The FTC provided the email addresses of class members in this matter, and (per the terms of our engagement with the **** Rust sent payments via ****** using those email addresses. Emails were sent to notify class members that their funds were available; this is the April 23 email that the complaint references.
We would emphasize that Rust did not establish ****** accounts for class members who did not already have them. If a class member did not have a ****** account,they had the opportunity to create one, or else they could request a physical check via mail from Rust. For a physical check request, **** would have to wait 30 days for the un-accessed funds to be returned to us from ******, and then begin the process of issuing the check, which takes additional time.
In this case, however, we are unable to issue a physical check because the funds were successfully deposited into a ****** account matching the complainant's email address. The emails she received from Rust in July and ****** explained this,and provided her with the confirmation number from ******. At this point the complainants funds are outside of ****'s control.
Concerns about fraud would need to be handled directly with ******. We would assist ****** with this in any way we can, but their privacy policies do not allow us to initiate a fraud investigation on behalf of one of their customers. We have no information about the suspicious emails described (from ************************* and/or the emails in the complainant's Promotion folder); Rust did not send those emails and cannot speak to them.Customer Answer

I am rejecting this response because: On or about April 23-27,2024, I contacted Rust Consultant requesting a paper check because I had NO Pay Pal Account. The Rust representative told me it would take 30 days before paper check could be issued so I called again in May now I'm told I have to wait another 30 days since my mailing address had changes since the date of the court filing.
My question is why all this time I am waiting for Rust to process a paper check it was July 26 when I receive a suspicious email from ************************* saying she has the money?
I recently found in my Spam mailbox correspondence from Pay Pal: May 15th welcoming me to pay pal May 22 offering me $15 June 15 offering me a statement July26 email from ************************* saying she got the money then on August 14th Pay Pal sends a statement.
Now I NEVER opened a Pay Pal account.
I can assume someone in May opened a Pay Pal account and by July they withdrew the funds.
Why did it take Rust Consultants between April - July to issue a check to me? I think **** Consultant has failed to carry out the duty that the *** request they handle on their behalf. I am not accepting Rust explanation of why my money was not given to me. Who would know my name, email address etc., and funds pending with pay ***? Its highly possible someone in Rust Consulting organization is responsible.

I am writing to file a formal complaint regarding the administration of an *** settlement payment by Rust Consulting. The issues I have encountered have caused significant inconvenience and potentially denied me access to funds to which I am entitled. I received a letter in March 2024 stating that Rust Consulting had previously sent me a check on 12/27/2023 as a result of a settlement. I never received the initial check because it was sent to a previous address and never forwarded to me. On March 25, 2024 I called Rust Consulting and notified them I never received the initial check and was told to email for a replacement check, which I did on the same day. I confirmed receipt with a call center worker on 3/25/24 as well. On April 2nd I received an email stating "Your request for a reissued check has been received. Checks are reissued approximately every 8 to 10 weeks." I have requested on multiple occasions that they provide a future distribution date or tell me when the last distribution was so that I could be on the lookout for the check. The amount of the check is ~$25,000. Every time the answer has been "we do not have a distribution date at this time or we do not have any information available" It has now been 11 weeks and still no answers provided.Business Response

I have reached out twice to this company to have a check reissued that never arrived from the Valuc/******* settlement. Twice someone had confirmed my address. Twice a check has failed to appear. The original settlement checks went out the end of January 2024. Its now Memorial Day weekend 2024. I am tired of waiting. I dont want any more calls confirming my address, they have it. There was a provision in the Settlement Agreement to accept late claims through December 25, 2023, and the parties decided to extend that deadline another month until January 24, 2024 (the day before the Final Approval Hearing). There is not a provision for paying any claims that came in after the Final Approval Hearing.
The complainant sent an email to Rust on April 16,2024, with an attached claim form. The claim form was dated (by the complainant) April 16, 2024. Nothing in the email indicated a reason as to why the claim form was being submitted nearly five months after the November deadline. The late claim is invalid and the complainant is ineligible to receive a payment under the terms of the settlement.Customer Answer

Rust Consulting is in receipt of the follow up to complaint #********. The complainant appears to suggest that **** did not take steps to inform him of the process and/or the deadline to file a claim for payment under the settlement.
On September 26, 2023, Rust mailed and emailed notice of the settlement (with claim form) to the complainant. These materials included the instructions and deadline for filing a claim. ******* was returned as undeliverable, and on October 4, the complainant called **** to ask about his award amount. All of this suggests he received one or both versions of the notice, was aware of the settlement, and had access to its details (including the claim-filing deadline).
On November 10, he was emailed a reminder (with another copy of the notice) of the settlement and the approaching claim-filing deadline.
The complainant's eventual claim, emailed April 18, 2024,included a copy of the front page of the notice we had emailed to him, which again demonstrates he had received the materials providing the claim-filing instructions and deadline. The late claim is invalid, and so the complainant is ineligible to receive a payment under the terms of the settlement.Customer Answer
