I am writing this email to express extreme safety concerns and unlawful actions that have taken place while residing at an MMC property. Months prior, my husband and I contacted the leasing office regarding hearing noises in our air vent. The office staff and maintenance team disregarded our concerns and did not assess the situation in our home. Now, my husband and I are finding many mice dropping all over our home. The droppings are seen daily on our couch, dining table, kitchen counter, and all over our floors. We have asked the office team and maintenance to take further actions; however, they continue to repeat the same steps without different plans (pest control, placing mouse traps, deterrents, and entering the crawl spaces). We have given them well over 30 days to resolve this issue, but they are constantly telling us that they do not see any evidence of mice being in the home. Not only is this a health concern, but I feel like I have been treated beyond unfairly by the office staff and *****, the regional manager of our community.Business Response

8/25/2022 I applied for a rental property, they took the $102 application fee immediately, the place I was applying for had no other applications in at that time. I never heard back from them, so I called to check on the status today, 8/30/2022. The property is no longer available, and they said they emailed me 8/25/2022 saying I was denied, but I did not receive any email from them, including junk mail. So now they won't return my application fee, even though the property is not available.Business Response

Unfortunately, the application did not meet our resident selection criteria and it was declined. Their application is attached for all parties to review. After the application was screened we emailed a decision letter to both applicants from our software, not our primary email address. I have attached a screen shot of the events from within our user portal. Furthermore, the second page of the signed application states that application fees are not refundable. You may find that attached as page two of the application, under fees and deposits, section A. Due to the aforementioned reasons I am unable to meet the consumers refund request. Thank you for the opportunity to respond, we are thankful to have an A+ BBB rating and serve our community daily. I had to call them. They simply took my money and did nothing. Here's my emails, with no response from them on 8/25 like they claim. Only the email where I sent them my wife's ID. And my phone records from 8/25, no calls from them, only where I called them that morning. Unfortunately, I can not say what was received (Phone Calls or Emails). However, I can prove that we sent decision letters to both applicants. Please see the attachment, which shows the email transactions. They are on 8/25 at 3:34 and 3:36 p.m. Furthermore, the application, that the customer signed and agreed to, states that the application is not refundable for any reason. I have requested the final statement be reduced from $400 to $150 or lower. The reason I am requesting this amount is that I take full responsibility of the carpet burn 100%. However I am disputing being charged for the kitchen due to the floor lifting a few months prior and the maintenance man fix it with a "hot glue gun". The flooring would still be replaced with our without any minor damages. Also, to make matters worst I received a document with another tenants name on it and their response was "I can understand the confusion". This shows that the property manger ****** that replied to me is to busy in a hurry to charge me for additional fees. I sent an email that provided my reasons why I feel like this was reasonable and the last email with me requesting to speak to someone else was basically telling me in my interest I should just pay it because if it goes to collections.... well here's the unprofessional response I received when asking for someone higher. Please read below. "C****, The updated statement is already in the mail and on the way to you. The next level up would involve sending your account to collections, which would not be in your best interest, since it would add approximately 40% to your account balance when placed, according to your lease agreement. The $400 balance would become $560 if unpaid after 30 days and filed with **** **** ********* Collections. My offer to help you set up a payment plan is still available if want to take advantage of that offer, please let me know. The customer signed move in condition report, Please note that there were no burns in the living room or kitchen flooring upon taking possession of the unit. 2. The signed Lease Agreement that helps guide all parties through the landlord/resident relationship. Section 49 of the same agreement gives us, the landlord, the right to charge for any damages that exist at the time of move out. 3. Our estimated damages and charges worksheet that we use at move out. This form establishes a dollar amount for burns in the flooring that all parties previously agreed to and signed. 4. I have also included pictures of the damages for you to view, there were more than 8 burns on the flooring, but she is only being charged for the items on her final account statement. 5. The corrected final account statement that was sent to the resident most recently. 6. A copy of our email correspondence where I tried to resolve the issue with the resident directly, but was unsuccessful. I am unable to reduce the amount due, based on the information above which include legal and binding documents. We have an A+ better business bureau rating and we strive to keep it that way. As I stated I'm being overcharged for the damages. Now that the images are proof as well as the upload that states "Estimated Carges and repairs" that they have sent shows that they are overcharging me. 1. There's 1 carpet burn $50 2. There's 2 vinyl squares that are showing damaged in the images that were sent by the leasing office. That's $24 So the actual amount should be $74 from the evidence that was downloaded by the leasing office. Please see the damage and repair sheet that was downloaded by the leasing office that shows the damages are not $400 worth of damages. Also, the emails show no one was willing to work with me to see they are in the wrong but to set up a payment plan for being over charged. Now, I am asking the leasing office to review their own images and the repair sheet and redo the amount. Please count your vinyl squares and the 1 carpet burn. Please see the attached picture of the carpet. There are multiple burns that can easily be seen. 2. Please refer to the signed estimated charges for repairs and damages form. You were charged for burns to the flooring. Vinyl sheet goods are charged by the square yard, not by the squares in the vinyl pattern. I would estimate the kitchen area to be roughly 25 square yards, multiplied by $12.00/yd comes to $300.00. Furthermore, the top line of the the aforementioned form states that charges are subject to change if actual charges are more than estimated. Our actual charge to replace the flooring was $1527.36. If the customer wants to be charged by the yard, plus the carpet burns it would be more than what has already been charged. The other way to estimate or charge a resident is based on a pro-ration, considering the depreciation of capital items. Using that method, the remaining lifespan of the vinyl and carpet is approximately three years, based on seven year term. This would make the remaining flooring value $654.57, which is more than what is being charged. I am willing to work with the customer and offer a $50 discount in good faith. I have tried to answer all questions, present the facts, and be flexible enough to offer a payment plan. We have zero unresolved issues, an A+ BBB rating, and help thousands of people with their housing needs in Rutherford County.
