    The business towed my car when it got stuck in snow, they damaged the filler neck connected to the gas tank. They also ripped out a hose connected as well. The neck was bent in multiple places. I have videos and pictures showing proof they towed our car. They harassed us inside their store when we confronted them. Had to pay another company to tow it to a shop to get it fixed and had to pay the shop.

    customer states that we damaged her car while in tow. 

    customer called after getting stuck in the snow during a NO TRAVEL ADVISED and INTERSTATE closings due to extreme weather conditions. Customer decided to drive on an old highway which was labeled as no travel advised. customer was 6 miles out of city limits. snowpack was observed in the fender wells and undercarriage of vehicle by driver. tow mini-J hooks (picture attached) were set into tow points on the frame (rear) (picture attached of tow points). Filler neck to a ***** *** is approx. 12" above the frame, there is also the plastic guard in the fender well that protects the filler neck from Debris (i.e.: rocks, etc.) (Picture attached with red circled area showing fender well). repair shop also stated that there was no physical way for the chains to reach the filler tube and was most likely, due to age, broken before the impact with snow and most likely snow impact finished off the broken filler tube. driver of other tow company is the one that removed filler neck. 

    customer and vehicle were delivered to a local hotel for the night. car was unloaded while customer was in hotel getting room.

    damage waiver: due to a call from local Police Dept our driver left without signature as PD call was an emergency. customer was still in hotel getting a room for the evening. customer at some point went outside to the vehicle. customer stated they noticed fuel door open then stuck hand in. customer then called another tow company (a company that is as easily stated as a rival company) that company preceded to tell them that we had broken the part, they towed it to a repair shop where they repaired it. repair shop stated that it was not possible that it was broken by us to the customer.

    bill was paid in cash along with a $** tip to driver. cash paid and tip was returned to customer, and they were told to leave the premises as the area they were in was a separate business. the owner of that business told them to leave.

    our damage waiver: Section A:) Tow and Recovery Authorization and Damage Waiver
    Upon signing this document, I am freely admitting that I have the legal right to authorize TIM’S TOWING AND RECOVERY LLC to recover and tow my vehicle. I also agree and understand that circumstances outside TIM’S TOWING AND RECOVERY LLC control, with regard to the accident or disablement involving my vehicle, may make recovery and removal of my vehicle unusually difficult. And I unconditionally release, waive and discharge my right, whether by contract or under operation of law to file cause of action(s) or claim(s) which I may have against TIM’S TOWING AND RECOVERY LLC Including the right to sue now or in the future. 
    Damage Disclaimer: My vehicle may be damaged if winched, towed, unlocked, jump started, tire changed or left on unattended premises. I recognize the difficulty involved and I agree not to hold Tim's Towing & Recovery responsible for such damages should it result.
    Section B:) GENERAL RELEASE OF LIABILITY
    I hereby assume any and all risk of loss, liability, damage or costs, and understand that any and all damages that may occur will be as a result of the accident or disablement and not as a result of any negligence on the part of TIM’S TOWING AND RECOVERY LLC. I fully understand the terms set forth in this form, and I hereby waive my rights freely and voluntarily without any inducement, assurance, or guarantee being made to me to the fullest extent allowed by law.
    Your towing professional believes damage could result in servicing your vehicle due to one but not limited to the following reasons:
    Position of Vehicle
    Construction of Vehicle
    Previous Damage
    Normal wear and tear from age of vehicle, owner neglect (i.e.: rusted metals etc.)
    Type of Service
    Tire Change
    Weather

    Wheels placed on vehicles need to be inspected and have lugs re-checked for proper torque within 50 miles.

    In the event there is a NO TRAVEL ADVISED on date of service, vehicle owner assumes any and all responsibility for any damage caused by signing this document. 

    Disclaimer: By signing this form you authorize Tim's Towing and Recovery Ilc. to debit your credit card for the amount above and credit card fee's. Signing the above form makes you responsible for all charges! If you dispute this charge, you will pay all applicable fee's that may be charged to our company.

    I hereby in consideration of the above-named towing company providing towing service release and hold harmless the towing company and all employees of said company. I understand that such service involves possible risk of damage to my vehicle and do hereby expressly accept all of the risk and all damage.

    Knowing this, I assume full responsibility for any damages incurred in the servicing of my vehicle, not caused by the sole negligence of the towing professional.

    I have read this document and understand I am releasing TIM’S TOWING & RECOVERY LLC and its employees from liability from damages due to the aforementioned reasons. I understand that, by signing below, I am voluntarily surrendering certain legal rights.
