This contractor installed a new deck in 2022 before I purchased the house. During my inspection, a safety hazard was noted and repairs were recommended. At least 2 of the deck planks were not secured appropriately and the edges were protruding up, creating a danger of tripping during normal use. The seller's agent provided me with the deck Contract which included a 10 year warranty on defects. I contacted ***** (who I understand to be the owner of the "decksunlimited" company) via text and he agreed to fix the defect/hazard. I then contacted him NUMEROUS times over the next month, attempting to schedule the repair and explaining my timeframe (as I still live out of state), giving him MORE than ample time to arrange the repairs but he NEVER responded to me again. I finally felt I had no other option but to arrange for someone else to make the repairs and I made arrangements with a handyman recommended by my real estate agent to make the repairs. He had to purchase a parts kit ($40) and charged $200 for the work which required him to remove numerous planks, saw them down, replace them, and secure them to the base. He informed me that the deck planks had clearly been installed incorrectly in that area and it appeared the contractor had "run out of materials" and had therefore finished that area without even bothering to secure the planks to the deck frame. He also stated that his repairs couldn't completely fix the problem because that would require the-doing that area of the deck but that at least the planks would now fit in a way that would not force the edges to stick up/higher than the rest of the planks (see uploaded pictures, contract, and text message exchange for more detail). I wish to be reimbursed for my out of pocket costs to have the warranteed repairs completed.
