    Date of incident 9/10/2022. I called fox's pizza in vandergrift around the hours of 10:30 am est. I order 4 big daddy pizzas total sale was 87 dollars. I placed the order in the morning for a 4:30 pm est pick up time. Foxs pizza called me one hour later to ask me to pick up pizza, i explained the pizza was to be picked up at 430 not when i called. The call dropped and i assumed everything was ok for the afternoon pick up. 2 hours after initial call i received a call from the vandergrift police department telling me to pay foxs pizza or it would be considered stealing. I informed the officer i will go doen to foxs pizza and handle the amount due and pizza pickup. When i arrived at the buisiness the employee informed me the pizza is still here for pick up since this morning at this time the pizza was 6 hours old. I asked if the pizza was stored properly using refrigerator or heating device and both the owner and employee said it was sitting on a table in the back for 6 hours. I tried to argue the health concerns with the mishandling of the pizza and asked if i could get a fresh batch. The owner refused and said if i did not pay and take the old pizza he would call the cops. I paid the bill to avoid being taken to jail over something that i didnt even take yet and left. I was polite as possible and offered to pay half for the old pizza and order new ones they still refused and refused to work anything out with me. This is a helth vuolation and seems like blaclmail. I had no idea what happened to that pizza on the table for 6 hours, me and my family did not feel comfortable with eating the pizza. We ended up throwing it away and losing out on 87 dollars because the owner refused all other options.

    The female customer called Fox's Pizza Vandergrift Saturday 9-10-22 at 10:57 am.  She ordered 4 Big Daddy Pizza's.  The bill was $87.12.  We routinely ask for pick up or delivery and what time.  NEVER did the femaile caller mention 4:30 pick up.  We called her back at 11:40 to tell her the pizza's were ready for pick up.  She told my employee that she ordered from the Apollo Fox's.  She was instructed that she was responsible for this order and she hung up.  I called back with no answer and explained that she was responsible for the order or the police would come and collect payment.  No response.  Two hours later the Vandergrift police went to the residence and connected with this femail through the ring door bell.  She stated "How do you know it was me?"  The officer showed her the receipt from the caller I.D. with her name and phone number.  She admitted that she ordered and would pay the $87.12. During the police investigation the officer discovered that this female ordered at the Apollo Fox's at 11:03 am, plenty of time to cancel the order at Vandergrift.  The females husband came to the Vandergrift Fox's and questioned and intimidated or teenage female employee for 45 minutes until I arrived.  The male repeatidly asked if the phone call was "recorded" and stated "it's our word against your word" about the 4:30 pick up.  I held my ground and explained that 4:30 was never mentioned.  The pizza's were stored in a climate controlled walk in refridgerator.  This individual called the health department, they investigated and found the food was properly stored.  The male demanded the pizzas so we gave them to him.  He stated that if the ordered was in his name he would go to court.  He caused the female employee much stress and anxiety as he yelled at her and questioned her.  This male never offered to pay half for the order and the female instead of hanging up could have explained the situation and negotiated but tried to ignore the situation.  This female is employed by the Leechburg Foxs and should know what a burden it is when customers don't pick up and pay for orders.  The police report is available for review from the Vandergrift police department.  This owner was never given any other options to rectify the situation.  The bottom line is these people were held accountable and they didn't like it.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
     
    Clearing up buisiness responses as they are inaccurate. 
    First my wife does not currently work or has never been employeed by a foxs pizza place ever. This can be easily be proven and is evidence the buisiness has thier story mixed up.
    Secondly, I did not yell or raise my voice to anyone either the employee or the owner. I bet there is no evidence on this as it did not happen.
    My wife offered to pay half to the police officer on the phone over the pizza mix up.  The police officer let her go off the phone to call the buisiness and see if this was a valid fix for the mess up. The police officer called my wife back in a short time and then informed us we had to pay full price. 
    When i entered the place of buisiness the employee said how can we clear this up? I responded Id like fresh pizza and would gladly pay. She informed me that full price is the only way. I informed her i don't mind paying full price but at this time it was said by the employee and owner the pizza was sitting on the back table not stored properly. I asked if that was legal or safe she said she doesnt think it was. If this buisiness had cameras thos would back up my story but i bet cameras doent exsist either. 

    My wife thought she called apollo and ordered from Apollo foxs pizza, they happen to have the exact same order. My wife paid for the pizza. The officer confirmed Apollo had an order for a customer but mixed up the name. This was bought and paid for and can be proven.  After this order we were at my sons birthday party, my wife answered the phone and advise the cashier that she ordered from Apollo pizza , it wasnt untill the officer called then she relized she picked up the other customers order that was exactly the same. The officer can confirm this due to calling Apollo and finding the error. My wife DID NOT CALL both locations to do a double order. This was a simple mistake and the owner refused to work with us on paying cost and refused to make pizza newer then 6 hours old!!!

    The employee and owner both stated the pizza was not properly stored. If the pizza was not 6 hours old and properly stored i would not have gone this route. In the common wealth of Pennsylvania title 28 chapter 111, it states "Perishable foods shall be refrigerated at the proper temperature and in an orderly and sanitary mannor as provided by regulations by the department of environmental 
    Resources".

    The owner has lied countless times over this 87 dollar order. The bottom line despite the mix up i asked for newer pizza less then 6 hours old and the employee and owner refused. A table is not proper storage despit the comments made from the buisiness. I challenge the place of buisiness to prove camera recording if any to back my story but like the lies from this buisiness they wont be provided because it would only expose the owners lies. Look at the cameras and you will see my pizza boxs on the table where the employee and owner said it sat. This is unsanitary and a health code violation.
