    I have been a 30yr member of the Carnegie Library of Homestead Athletic Club. I also utilize the library for recertification of First Aid/CPR, my annual taxes and the Music Hall for concerts. These particular incidents involves the Athletic Club, an unsafe workout environment, a membership termination letter, and retaliation. On 1/31/24, while I was working out with the fan blowing directly on me another member, white male, came inside and unplugged the fan. When I approached the member to ask why he unplugged fan, Dan Ki*******, the gym manager who is also a white male, heard the altercation and threaten to remove fans from Athletic Club. I told him, "If you remove these fans do not ever speak to me again." The following day, I notice Do Not Open signs on all the windows and all the fans were removed from fitness center. Over the next few days, Dan would speak, provoke and taunt me by laughing. On 2/2/24 while I was waiting to get on elevator, Dan got off the elevator and began to laugh. At this point, I was frustrated, and stated, "Oh what's so ******* funny, **** ***," and proceed onto the elevator. When I got to the fitness room, Carol S******* white female Director, ask me to come to her office. I followed her to her office and she stated to me, "Chuck there is no profanity here." I told her, "that Dan K******** has been provoking and taunting me the past few days." She replied, "I don't believe you!" I then said, "I don't want any trouble and I will be leaving this gym to find another gym with air conditioning," and walked out of her office. The next day, 2/3/24, when I called gym to request refund of my membership because I had just paid it for the year on 1/24/24, I spoke with Stan, the gym attendant, and provided him my current address. Upon me leaving, several other members and a minor, who is Carol's son best friend followed me to my current gym, Fitness 19. On 2/12/24 I received my gym membership refund of $200 along with a membership termination letter. In retaliation, Carol has also revoke my privileges for utilizing not just the Athletic Club, but the Library and Music Hall, also. Carol was upset that the minor, who is a friend of family, has followed me to Fitness 19 and she made negative statements about me to the minor in attempt to tarnish my character.

    Our records show that this patron paid to use the Carnegie Library of Homestead's Athletic Club for the first time on January 15th, 2013. Since that time, he has paid intermittently to enjoy and benefit from Athletic Club's amenities.  He has been a sporadic member of the Athletic Club for the past 10 years.

    In the initial complaint, this patron willingly admitted that he used profanity, which is a violation of our Code of Conduct. 

    On Friday, February 9th, this patron shouted profanity toward an employee, and in front of several young children and their parents.  This behavior created a hostile environment for both employees and patrons, particularly children. Such behavior is a direct violation of our Code of Conduct, which has been adopted by our Board of Trustees and is displayed throughout our premises, including the gym area. As stated in the Code of Conduct, the Carnegie of Homestead reserves the right to terminate access to the facility at its discretion in the event of any violation of this Code of Conduct or any rule or policy.

    This patron requested and received a full refund for the unused portion of his membership.

    Policies at the Carnegie Library of Homestead have been established to ensure the safety and enjoyment of all staff and patrons. Our policies apply to everyone, regardless of their length of membership.

    I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    [To assist us in bringing this matter to a close, we would like to know your view on the matter.]
    I understand and regret that my choice of words used at the time when addressing this employee was very poor, however this employee has been provoking and taunting me for the past several days at this point. Profanity is used daily throughout the Athletic club including the gym area. 

    The issues here are the saftey hazards from the removal of fans and the signs prventing the use of the windows. Its gets extremely hot in the fitness room.

    In 2000, I fought for years to have these specific fans in place at the fitness center.

    As far as me being completly banned from the facility should not be up to Carol S****** because Carol has made it personal. I recommend the board makes this final decision on this matter.

    The Board of Trustees for the Carnegie Library of Homestead is an 11-member board.

    Per the claimant's response to "recommend the board make this final decision on this matter," the Board of Trustees reviewed the situation and voted unanimously, 11-0, to uphold the decision to ban the claimant from the CLoH facility.  This decision will be reflected as a matter of record in the minutes of the next board meeting.  

    The Carnegie Library of Homestead considers this matter closed.
