    I entered into a contract with KMJ on September 13, 2022, for the renovation of my property at **************************, Pocono Pines, PA *********. I made 3 installment payments of $13,000 on October 6, 2022, $19,500 on November 1, 2022, and $13,628 on January 19, 2023. The second installment was made after KMJ claimed to have ordered glass for front windows to be installed in the home. A total of $46,128.00 was paid. KMJ has left my home in a completely uninhabitable state and stated on April 1, 2023 that they could not complete the job. Despite being given instructions on how to return funds to me, they have refused to respond to all text messages, emails, or phone calls and it is clear that they intend to run off with my money after leaving my home in shambles. I have since discovered two other clients to whom they have done this. Pennsylvania Unfair Trade Practices and Consumer Protection Law UTPCPL states that I am entitled to receive compensation for the damages I have suffered due to the contractor's breach of contract. However, in this instance, I am simply requesting the return of original funds of $46,128.00. Furthermore, I am dubious as to whether KMJ has registered with the PA Office of Attorney General as required by the Pennsylvania Home Improvement Consumer Protection Act (HICPA) as he never provided guarantees of workmanship to us. I am requesting that the Better Business Bureau take action against KMJ and report them to all relevant authorities in the area. Please let me know if you require any further information or documentation to proceed with this matter. I am attaching more detailed documents below.     We signed with ***** on July 20th 2022 to replace a porch and build a deck. As a contractor he was supposed to obtain permits. He replaced porch (improperly, without footings or proper board connectors) without a permit which resulted in a violation. We later paid fines and after months of back and forth we finally got the permits for deck construction in October. It is now January, we do not yet have a deck, his crew dug holes that are too wide but not deep enough, and built a "temporary frame" over that, which would not pass any kind of inspection. ***** stopped replying, no work is being done since November. This is the most major issue aside from electrical work that was done leaving a hole in the wall and a box of wires. We paid over ****** from our contract price. I now have to hire a different contractor and pay him even more to fix the current mess - dig deeper holes but then make them more narrow, take apart the frame, install footers for the replaced porch support beams, secure connections in porch frame, among other work fhag needs tk be done). ***** scammed us. I have been trying to resolve this amicably for months, I will get a response once in 2 weeks that everything will be handled and he goes missing again for 2 weeks with no work being done. He knew that we were not very flexible on time to have a year to build the deck.He also initially took our signed copy of the agreement and never returned it, but I am attaching a copy of the proposal we signed as well as checks for moneys paid.

    There were events out of our control causing the delays to the job completion. For some context we started this job immediately after contract was signed, we rebuilt the rear porch which went way beyond the scope of the contracted project this was completed and paid for by *******. The entire issue was permitting when we applied for the permits thee was a 90 day delay in receiving the zoning and building permits, I could not have my crew on standby I had to start other jobs. When the permits were finally approved the owner ******* said she would pick them and take them to the HOA for their approval and permit, they had to have the zoning and building permit prior to submitting the application to the HOA. When the owner took the permit paperwork to the HOA she gave them the entire package including the signed prints and inspection signoff form. We proceeded with the project to inspection where it was failed due to not having the permit package. When we were informed of this we went to the code enforcement office to receive another copy and were told they don't give copies we would need to petition for a copy and we did. We then went to the HOA office and were told they don't retain copies of the paperwork and that they gave what they had to their inspector after spending an extended time at the HOA office they found a copy in their computer and printed it for us. Needless to say we were involved in a project we could not just pick up and leave, we then ran into the holidays. During the down time of this job we had an emergency call from the owner that the heat wasn't working we hired heating contractor had it repaired and paid for it no charge to the owner $545.00 we also told the owner we would stain the porch for no cost and we also moved a thermostat in the living room for them at no charge. I feel we were fair with them and did not take payment and walked away. We are currently doing this project as of 1-24-2023 
    As a side note material for this project was on site the entire time.
