                  RE:      Lezzer Lumber, Inc.
                              Complaint #:  ********

      To Whom it May Concern:

I represent Lezzer Lumber, Inc. (“Lezzer”) and have been asked to respond to the BBB on behalf of Lezzer regarding the above-referenced Consumer Complaint.

Lezzer is primarily in the business of selling building materials, including as a vendor for many third-party manufacturers, including cabinet manufacturers.  As a vendor of third-party products, Lezzer generally passes along any warranty on such products offered by the manufacturer, and assists its customers in pursuing applicable warranty claims when appropriate.  Here, Lezzer sold certain cabinets for use in a home. The cabinets were white in color, with the cabinet manufacturer having used its “Glacier” paint color and enamel coating.

Earlier in 2023 the consumer contacted Lezzer about discoloration they observed in the panels of the cabinets – essentially a yellow or brown tint had emerged on the face of the cabinet panels.  Lezzer reviewed the issue and contacted the cabinet manufacturer to investigate and/or honor any applicable warranty.  The cabinet panels smelled of cigarettes, but because the cause of the issue was not readily apparent, the cabinet manufacturer commissioned chemical testing of the discolored cabinet panels through a third-party laboratory.  Those test results were provided to Lezzer. In short, the lab found that the surface of the panel “…showed a significant level of nicotine was present.  The sample of coating analyzed contained 4200 ppm of nicotine or 0.42% by weight.  The test affirms that the door was exposed to prolonged high concentrations of cigarette smoke, which is the likely cause of the panel discoloration.”  That test result was provided to the consumer and a copy is attached here.

Notwithstanding this conclusive testing, the consumer has apparently claimed that no cigarette smoking ever occurs in the residence – although they have admitted some cigar smoking occurs.  This exposure to “prolonged high concentrations of cigarette smoke” voids any warranty on the appearance of the panels.  While Lezzer has attempted to assist its customer, there is no warranty, representation or applicable law that would require to compensate the consumer for environmental damage they caused to this product.

Lezzer will consider this matter closed unless we hear from you.
