    On September 25th KO Tree Services (****** "Cowboy" ******) stopped by my house and quoted a job to cut down 3 trees and prun 3 trees. I agreed to move forward and KO was going to come out the next day and complete the job. Due to the hurricane KO didn't come out on the 26th. I never heard from KO again. KO Tree showed up on 10/8/24 and started cuttin down trees and prunning. I saw this activity on my front door camera and left work to come home to inquire about a tree they were only going to prune, i wanted to have them take it down after the storm. Nothing was said to me about which trees they were cutting down. I went back to work. When i returned home i noticed KO had cut down the wrong tree. I called KO and notified them of the issue. The next day ****** "Cowboy" came back out and said they cut down the right trees. Cowboy balantly lied and didn't own up to the mistke KO had made. Cowboy tried to charge me again to cut down the tree. Had KO properly contact me before showing up out of the blue i could have been home to greet them and make sure we were all in agreement of which trees were to be cut down. Also KO drove their equipment on my property and messed up my lawn. "Cowboy" said they clean up great after their work and i wouldn't even know they have been there...that was not the case, and i have ruts in my fron yard that need to be repaired. I am asking for a $900 refund for the service they didn't provide. The $900 is the quote i received from another tree company to come in and take the tree down. I do not want KO back on my property since i can't trust them to do the job correctly, and communicate properly.

    Our contract clearly states no further notice is required to commence work. The exact language used is "Authorization is hereby given to commence work on or after the date written below at any time during K.O. Tree Services normal business hours without further notice." The date  on the contract was 9-25-2024. We also specified in the contract that "We are not responsible for ***air of dents, ruts, holes and divots caused by falling wood or equipment unless specified above." Nothing was specified in the description area in regards to ruts. The trees were discussed with the customer and we cut down the ones he selected.  He wanted more cut down initially,  but didn't want to spend the amount quoted. We worked a better number on a smaller selection and he agreed.  The goal was to reduce the number of gumballs in the grass. The trees we cut were at the edge of the yard. The tree he claims we didn't cut down is further away from the yard and actually outside of his property. He couldn't say we had definitely cut down the wrong tree. He said he thinks we might have cut down the wrong tree.  After discussion about the issue the customer wrote the check. Now there is a renewed complaint. The sales *** he spoke with has a clear mind and great memory. He has never cut down or instructed someone to cut down the wrong tree. That sales *** would also admit if he made a mistake and I would make it right. I am confident in saying that cut down what we agreed to cut.
