    I hired Smith Construction and Design to put in an egress window in my home. I made a down payment of $2,500. While digging, he cut a sprinkler line, and didnt bother to tell me. He just left! As a result, my basement flooded. I contacted him. He apologized and gave me his insurance information. He said he would return my down payment. He has not. I took him to small claims court, but he didnt show up. His insurance would not cover the depreciation, so I am out another $4,227.39. He left my yard a mess, and I had to pay to have that cleaned up as well.

    We initially contacted **** Smith (Smith & Company Construction and Design) in summer 2023 about installing an egress window. **** was recommended to us by a local window seller (store that doesn't install egress windows--hence the recommendation). **** came by our house to see the location, walked us through some options, and gave us a quote. He said that if we wanted to secure a work date, he would need 50% down--a request that didn't seem unreasonable to us given the extremely high demand for contractors in the ******** area. We wrote a check for half the quote: $3,370.00. The check was cashed/deposited August 22, 2023. **** told us to expect installation in September.September came and went. So did October. We reached out to him a few times during these months, but he did not respond to texts or calls. His email inbox was full. Finally, he did let us know that he could install in early November (and gave us a specific date). That day came. That morning, he texted to say he was running late but would be at our house by noon to start work. He never showed up. We tried to contact him to find out what was happening, but he did not respond.At last, we asked for a refund. This prompted him to respond to us, giving us a story about falling on hard times. We decided to give him one more chance (not knowing whether the story was true), and asked for a new install date. He did not follow up with us to schedule anything, however, and so we renewed our refund request. He then indicated he would send a refund check when "financially able." In the end, we gave him until January 15th, **** to provide a refund. On January 15th, he texted to say he could not give one. We offered to accept a portion of the refund as a sign of good faith, with the remainder to follow in subsequent months. He never responded.As it stands, **** has $3,370.00 of our money, with no services rendered. It is also evident he does not intend to pay us back.
