Mr. ********************** signed my Escrow contract and agreed to follow it. When an unexpected repair came to light involving replacing a boiler he did not go through the correct avenue to obtain a new signed contract. He instead kept the contract we all signed and when the ****** dollars of my escrow hit his account he went *** for a couple of weeks. Upon his return he then stated he no longer could keep the expected timeline due to his own properties needing attention. As for work done on our home he installed a new boiler and repaired some broken pipes. He would not provide any receipts for the work done or on the new boiler that was installed. I would like the money returned to me for my remaining repairs our signed contract is uploaded. ****** was half of my ****** escrow the remainder was to be paid upon completion of project.Business Response

We are very surprised to have recieved this email and response to the assistance with gave *** and *****. The complaint fails to mention that without us, the lender would not have closed the deal on this house. Several people had advised them that the house needed alot of work including myself. They had a total of 30k in escrow to use for repairs however the repairs quickly exceeded that amount. We were originally sought after to rebuild some decks and do some exterior miscellaneous rot repairs. Upon desperation to close on this house I was begged by the Realtor and buyers to help do whatever I could to get this deal to close. Upon closing the lender changed their priorities on what tasks needed to be completed. At this point before doing any physical work I had well over a hundred hours just setting up estimates, communications and trips back and forth to the property for issues that had to be addressed. Priority number one for the buyers and lender was running water. In order to do this we had to replace the boiler. I used a certified hvac sub contractor to replace the boiler and upon starting the boiler for the first time, they chased broken pipes concluding that all the pipes had to be replaced. The hvac and i agreed it would be impossible to replace small sections that had frozen the winter before in several walls. Between a brand new boiler, water filtration device, well inspection and my personal logged hours we exceeded the $15,000. To ask for this money back as if I did nothing to help them, is very insulting and confusing to say the least. I admit I ran into some business delays that I had to attend to, but we still were easily contactable and never ghosted ***** or ***. This is when they asked to release me as the builder so that they could expedite the renovations before December so they would not lose the house. I respectfully agreed. Unfortunately, contracting and renovations on a very poor condition property are enormous. What was being asked to be completed with minimal funds was not doable. ****** released the funds to us because the work I agreed to with the lender, had been satisfactory, otherwise they would not have released the funds. I was called several months later by another contractor, who i willingly gave information to and tried to help with any knowledge of the job that i had. At no point did anyone ask for a final invoice, however if they would like a final invoice it would be more than $15,000. I wish them the best and hope that they were able to get the repairs completed to their home.Customer Answer

Included pics of our convo explaining the funds were not used the way they were supposed to be.
Mr. Morse did not follow the contract nor did he go through the correct channels to ensure everything being done was per the contract that we signed. The way he speaks about our home being in such "poor condition" is insulting. Also paying ****** dollars for a ***** dollar boiler is also insulting. The filtration system installed (picture included) could not have made up the differnce alone. I want to see recipets and invoices, i want a breakdown of how much your labor was per hour. I also would like to know why you did not speak to me about options when we knew the boiler was bad? This is tye beginging steps to getting back to where I need to be.

We understand that the complaint has been rejected.. However the new boiler was installed and the owners requested to release us as the building. Escrow paid out the portion that they believe was fair. We ask the BBB to understand that we pride ourself with exceptional customer service and fairness. We have never had a situation like this occur. We have several advocated who dealt with these two first hand. Both the listing agent and lender will attest that we did everything we could to help them. I wish them the best of luck.Customer Answer

As I explained before, this was my first time buying a home and having an escrow account. We were approved for an FHA 203K standard loan which allowed us to find a home in need of repairs. There were quite a few unknowns when we signed, if Mr ********************** did not have experience in these types of deals he should have refunded my draw and then stepped away. Instead he changed the scope of work without getting the contract amended or As to the claim about having people "attest" to dealing with us! I find that remark both unprofessional and defaming.
My response to your answer is why did Mr ********************** not follow the written contract? Why did he not give me an option before taking all of my initial Draw which is not what I agreed to. Obtaining this home was almost impossible and we are still struggling to bounce back after this mess of a contract and project. I will end my statement by saying Yes I released Mr ********************** after he and his crew tried to withdrawal ***** more dollars from my Escrow with no explanation on why they wanted to take it, I rejected that draw and drafted the 10day letter. We have learned valuable lessons unfortunately all of them past the fact. I just want to make sure no one goes to Mr. ********************** business without someone stepping forward.. This was not executed correctly.
