    On June 11, 2020, claimant and Starcom executed a Professional Services Agreement for the site development and construction of a new commercial building and claimant made an initial deposit payment of $10,000. On December 23, 2020, Starcom provided an invoice totaling $15,075 for work allegedly performed between June 15, 2020 and December 17, 2020. Claimant made a $5,075 payment on January 16, 2021. Upon Starcom's demand, claimant made additional payments of $25,000 on February 11, 2021 and $55,565 on April 19, 2021. Despite requests from claimant, Starcom has never provided an invoice or identified any labor performed or materials delivered to the project after December 17, 2020 to substantiate these $80,565 in payments. On August 24, 2022, Starcom rejected claimant's demand for reimbursement of the $80,565. The Agreement states that if any dispute arises between the parties, it will be resolved through binding arbitration at the Better Business Bureau.

    Business Response /* (1000, 8, 2022/10/14) */ Dear Ms. ******: Contrary to the complaint we did not contract to do any construction work for the *****'s. Our contract was for professional services which includes design work, budgeting, product research, sub contractor bids, etc. I have enclosed the invoices that reflect what was brough forth in the complaint. There were other invoices but they are insignificant in context. Most of them were dropped off personally by me to the *****'s place of business or their home. The contract and invoices are very clear. After the *****'s engaged my company I learned that they had a history of not paying contractors which continued as I worked for them. This is the information I have received. They have a balance due with my company of $5525. A balance with *************; $550. A balance with ***************************** of approximately $2000. A balance with **************** of $6500 The documents furnished and their payment history prove their complaint has no basis. Sincerely, Robert E. W********** President
