    On July 17, 2023 we sent Mr. Finlay a check for $3,500.00 as a "retainer" as Mr. Finlay said. He said he would contact us in August. On the 9th of August I called him and said I was hoping he could give us a date in August when he would be starting. No answer and no reply. I did get an email from him on the 10th but I did not see it. (However it merely said he would be starting in August but no start date.) I drove to ******************************************************* where I saw there was no office just a sign and a mailbox. This was verified by the 2 business's that were there, a nail salon and a dry cleaners. They said no office he comes to get his mail. Very upset I left a note in his mailbox stating I must hear from him or I am going to the Police. When I got home he called very mad and abusive. I apologized and said does he want to do it or send us back our money. He said he was very mad and he would let me know! I put ******************** on the phone (as the owner of property he wrote the check but I had taken out a personal loan for $5000.00 and given it to him as the total requested by Mr. Finlay was$ $5,500.00). ******************** demanded the money be sent back and Mr. Finlay said he would do so. But I am afraid he will not.

    To whom it may concern:

    ******************** did send us a signed proposal and a $3500.00 retainer. We received this on or about July 20, 2023. We do have an office at ********************************************************************************************. We rent an office from the ***************** *************** Local ****. We are located on the second floor in Room 21. The entry door on the ground level is locked when we are out of the office, unless a representative of the *************** is in the building. They also have an office on the second adjacent to ours. We've been continuously renting from them since December of 1999.

    Prior to sending Mr. ******* the proposal, I explained to Ms. ************************ his representative, that we could start work on the project approximately 4-6 weeks after receiving the signed proposal and the retainer given our current workload and an upcoming vacation. I was away from July 30, 2023-August 9, 2023. The message on my office answering machine reflected these dates. ************** admitted to me that she heard this message when she called and left her voicemail messages on August 9, 2023. She left 3 voicemail messages on the office answering machine on August 9, 2023. I listened to these messages from a field assignment at about 4:00 P.M. on August 9, 2023. I send ************** an email at that time which stated that I had received her messages and that I would be starting the work the following week.

    When I returned to the office on the afternoon of August 10, 2023 I found a note in our mailbox from ************** threatening that she would contact your office and the police if I didn't call her immediately. I immediately called her and we discussed the above matter and I told her that I had left her an email the prior evening which she admitted that she didn't see until a few moments before the current telephone call.  I was in no way abusive but simply stated that this was no way to start a relationship. Our start date was to be well within our estimate of 4-6 weeks and she simply was becoming impatient. She asked if I was still going to do the job and I told her that I would think about it overnight because I didn't like the way she was approaching the relationship or the project. She told me that I was being ridiculous and put ******************** on the telephone. ********************** asked that I return his retainer which I put in the mail on August 11, 2023.
