    On 09/20/2022 *******************************, being the sole ****************** of Better Choice Construction LLC agreed (agreement attached) to do excavation/foundation job for me and was paid $20,000 to complete excavation. On 03/08/2023, he demanded more money & was paid $2,000 and on 05/20/2022 he, yet again, demanded more money and was paid another $2,000 (canceled checks attached). Todate, the excavation is only half done. Now (for about 10 months) there is a dangerous huge gaping hole dug (rain water pools therein), grass growing on construction forms, a backhoe, a *************** abandoned on site and street. The eyesore of broken fence and debris strewn all over the neighboring lots is unbearable. When asked when he will complete the job, he gives many different lame excuses and promises while continuing to do similar jobs on other neighboring sites using his other spare machinery and trucks. ***** has been requested (in writing) on two separate occasions to remove from site his machinery as he seems not interested in fulfilling the agreement. This has not been done to-date. He is literally using my site for parking/storage of his machinery and equipment.I am a 70 year old woman on Social Security. It is very painful to be paying on a construction loan (10 months now) with interest but without results. It is my ******* request to your good offices for intervention on my behalf so I can get either the job completed or some money refunded and the construction machinery/debris cleared off the site as well as the neighboring lots. Also, the contractor to repair the neighbor's fence that he broke.The job site address is ********************************************************. I thank you in advance.
