I signed a contract with *********************** with The Mail Box Store / Eagle Mail Express to start the build of a new shipping store. Prior to signing the contract, *********************** assured me that my $1,500 deposit was fully refundable in the event we did not find a suitable lease/space to lease. The contract also indicates that the $1,500 was fully refundable. In the midst of searching for a suitable space to lease, my mother was diagnosed with stage 4 cancer, and was given 2 months to live. I immediately advised *********************** that due to my family situation and me having to care for my mother before she passed, I was unable to continue with the contract and requested for my deposit to be refunded. *********************** refused to give me my deposit back and ignored several of my phone calls, e-mails and text messages moving forward. *********************** and his company owe me my $1,500 deposit and have breached the contract that we both signed. See attachments for copy of the contract, e-mail communication between me and *****, affirming that the deposit was fully refundable as the contract states, and certified letter to *********************** as a last attempt to collect my deposit money back. As you can see, this is a blatant contract breach on the part of ***********************. He has since ignored all communication with me, has intimidated me, threatened me in text messages and tried to "buy me into his brand" instead of refunding my deposit. His behavior has been completely unacceptable and unethical as a business owner. *********************** claims he has completed "work" that is worth $1,500, claiming that his communication with the commercial broker and him drafting up a "fill-in-the blank" lease was worth that much. However, I confirmed with the broker that she and ***** exchanged no more than 7 emails and there was very poor communication with ***********************, and that such communication was quite unprofessional on his part. I am requesting a full refund from *********************** per our agreed contract.
