      On May 13, 2024, I contacted the ********************************************* to remover a dead palm tree in my front yard. *********************** (I believe that he is the owner) stopped by my house to look at the tree. When he came by, he did not get out of his car. He looked at the tree while he was seating in his car and gave me a verbal price for the removal. Before he left, he requested that I Zelle $100 to him in order for him "to put me on the schedule". He also promised that he will get the job done within the week. On Tuesday, I contacted him by text message to inquire about when he was planning to come do the job. He told me that he could do it on Thursday, May 16 "middle afternoon" (text messages are attached). I texted him on Thursday at 12:44 pm to let him know that I was going to leave work to meet him at my house around 2 pm. He texted me back at 1:28 pm to let me know that he was on a large removal project and needed to reschedule for Saturday, May 18. I replied to him that Saturday will not work for me and explained to him that I had taken part of Thursday off from work in order to meet him at my house. I also told him to please refund my deposit by *****. Since then, I have had several text exchanges with ***********************, in which I have been very clear that, because that he did not keep his word to come on Thursday (a breach of the agreement), that I no longer wanted to do business with him and that he should refund me the money immediately. So far, he has refused to do so. Delray ************ has not done anything for me which would have entitled the company or its owner to keep my deposit. I am requesting that the company refund me the $100 deposit immediately as I no longer want to do business with the company and its owner.
