Hired contractor to replace the decking and handrails at my rental property in Estes Park. Because the house is mostly rented in the summer, I hired the contractor to complete the work between April 3-10. He was more than 2 months behind schedule, and wouldn't have been able to start until the middle of June. Because of this, as well as his unprofessionalism on a different project, I decided to terminate the contract on June 8. I requested he return my $7500 deposit within 2 weeks. He claims to have purchased discounted materials that couldn't be returned, and he didn't have money until after he gets more work. When I asked for a receipt or invoice for the materials, he never responded. I have had zero communication with him since June 22. It is my belief that he doesn't have the materials, didn't hold the money in trust, and misappropriated the funds. I would like my money back and not have to get lawyers involved.
