Salesperson sent a contract which required the following: Signature, deposit for windows. Contract did not offer: Possible date of completion Final or fixed price of windows offered Contract stated: Loss of deposit if customer chose not to continue with the installation of the windows. Believed that this constitutes a restraint of trade since no date of completion was stated in the contract, therefore it was open ended agreement without end... should Scheel fail to install the windows in a reasonable length of time, customer was out the deposit.

Spoke with Mr ******** directly, inquired as to why he felt it necessary to would write such a senseless review as "restraint of trade" is an action that interferes with free competition in a marketplace which has absolutely nothing to do with the terms of our contract. He responded by saying he didn't like the terms of the contract so he felt compelled to write a review? Thanked him for doing so and shared with him that Scheel has been in business 74 years and has fulfilled every customer contract to date without fail. Not that he cared to listen but a delivery date could have been added to the contract should he have requested same in advance of writing this review.

    ********** ********

I am rejecting this response because:

I had requested that a delivery date be included when talking to the salesperson, who was reticent about bringing it up with his management.  When the contract was resent, no changes were made to the body of the contract with regard to delivery, although an addition was made for the leaving of the removed windows.

If the delivery date had been included I would have had NO reason to complain.

The individual who called my wife, did not identify himself to me, when I took the call.  As I was in a meeting, I listened to his comments which were argumentative, and I understood his employee's reluctance.

It appeared that the caller did not wish to listen to my comments, so there was then no point in further discussion.

    Sincerely,
