    On January 17, 2023 we placed an order for a headstone and paid a deposit of $882.20 via etransfer which is 50% of the total cost. My daughter called and spoke to *************************** on February 15, 2023 and asked when the headstone would be ready, as we needed to arrangement to transportation to *********** by April 8, 2023. **** said they would not have it ready in time, that they had many orders and that we should postpone our ceremony. She said she hoped to have it ready March 31, 2023 but she couldn't guarantee that it would be ready. We cancelled the order on February 28, 2023. On March 3, 2023 we agreed to pay **** $150 for the time that the company put into the order and requested the remaining deposit of $732.50 back via etransfer. **** is refusing to return our deposit because she wants us to show her the new design that the new company developed for us. We have refused to show her our new contract and our new design. We have sent numerous emails and left voicemails for the company to return our $732.50.

    Hello, The ****** family (***************) requested the marker be done by a certain date, however I could not guarantee that it could be done by their planned memorial date, due to the extremely high volume of orders of people dying from the vaccine shot. The family requested a refund after the marker design was approved. They said they found another company in ******* ** that would be able to accommodate their completion date request. I am willing to give them the refund under one stipulation: they send the design the other company provided, so I can be sure they would not use my design. 

    As stated on the invoice:

    All exclusive and original designs by Century Monuments cannot be reproduced or displayed by a client or another company with the intent to mislead others that the Work was created by anyone other than Century Monuments.

    I suspect that they have given my design I created to the other company to reproduce, so that is the reason they have refused on numerous occasions to send me the proof. 

    If the family is able to send me the approved proof from the other company, then we will most definitely send the refund!

    I am rejecting this response because:

    Century Monuments did provide the layout for a headstone, however we do not agree that they "own" intellectual property over the ********* design that was created by ***** Artist, *****************************, who is my nephew.  Obviously we would be using the exact same wording for the headstone (my brother's name, date of birth, date of date, a slogan and his ancestral name).

    We offered to compensate the company for the time that they put into the layout and they asked for $150 and we agreed.  However, when we did let them know we would not be sharing information from another company, they refused to give any of our deposit back.  We are owed $732.50 from the company.

    There should be no reason why they cannot provide our refund.

    We never claimed the traditional Haida art was our property, but the layout itself, the font style and placement is.
